It’s a man’s world

Time and again, I have heard that it is a man’s world.

A man is murdered every 19 minutes as opposed to a woman every 66 minutes. The number of men committing suicide is twice the number of women committing suicide. At home, men are twice as likely to be driven to commit suicide as compared to women. Outside home, men are getting murdered three times as compared to women.

82% of the taxes collected by the Government are contributed by men and Rupees 11,400 Crore is spent annually on women’s welfare. Not even a single rupee has been spent on men’s welfare in the last 60 years the country has been independent. There is a ministry for women and a ministry for children. There are protection laws for almost everyone and everything – including women, soil, animals, fisheries, forest etc. The only entity inconspicuously missing from the large list is men.

Talking about protection, even the domestic violence laws of the nation are gender biased. Only a woman can seek relief from the court under the recently enacted domestic violence act.

On the complaint of women, even 2 month babies have been arrested by the police for causing extreme mental harassment to women.

In the court of law, men are presumed to be guilty unless proven innocent. And given the abysmally slow pace of legal proceedings, it takes decades before a man can prove his innocence.

Adultery is a crime for men while women can legally do it. What is more interesting is the fact that women can now claim alimony from their illicit partner as well. By the way, unlike countries like USA where alimony is only for long lasting marriages and for a specific period of time, in India women are entitled to life-long alimony payments even if the marriage lasted 1 day.

Indian courts, including the Supreme Court of India, routinely forgive women for contempt of court and perjury because of their gender.

Any un-natural death of a woman within 7 years of marriage sends her husband to jail automatically. The most common cause of an un-natural death is suicide; and we already discussed that men are twice as likely to commit suicide as compared to women.

1.12 males are born to every female. The ratio declines to 1.10 by the age of 15; to 1.06 in the age group 15 – 64; and 0.90 for the age group 65 and above. This seems to imply that girls are either genetically superior to boys OR they are protected and men are made to do all the hazardous tasks.

As a matter of fact, worldwide women live on an average 5 – 7 years longer as compared to men. Still, the importance given to women’s health is many times more as compared to men’s health.

Talking about women’s issue is in vogue but people ridicule when a person talks about men’s issues. Hence there are hardly any opinion articles written about men. I personally spoke to an editor of a well known Indian national newspaper and he said “I agree with you in principle but I will not be able to publish any of your views. They are anti-women and the women will sit outside my home on a hunger strike”.

So, people are scared of women, and perhaps because of valid reasons. Last year, women activists forced their way into a High Court and broke the wooden chair on which the judge used to sit because he delivered a judgment in the favor of a husband in a matrimonial dispute.

Talking about the courts, a few months back a Supreme Court judge, while deciding on a matrimonial dispute, clearly told the man “Do as your wife tells you. If she says look this side then you look this side. If she says look that side then look that side. We all have suffered”.

The president of India is a woman and the most powerful politician in the country is also a woman. And still they say it is a man’s world!

* Idiots, pathetic, uncouth and inferior creatures who are constantly in need of rescue by their “superior” wives, girlfriends or female relatives who are set to overhaul them;

SASARAM: Can Class I and LKG kids torture and assault a woman to death? Or, to be more liberal, can children of this age collude with their grown-up kin to execute a killing in their household? Indian Penal Code (IPC)’s Section 82 says: “Nothing is an offence which is done by a child under seven years of age.” But either Kaimur police have not read the rule book or they care a damn about it.

In yet another instance of sham police investigations making ridiculous conclusions in criminal cases, Chaniya Khatun, 6, and her sister Soni Khatun, 5, along with six other family members have been held guilty by police of having killed an 18-year-old woman.

With Kaimur superintendent of police P K Srivastava agreeing to the Bhabhua DSP Sanjay Kumar’s supervision note and ordering the arrest of the accused, the eight, including the two girls, are likely to be arrested “any moment now”. “I have already procured a warrant of arrest against the eight accused,” said R K Singh, station house officer of Sonhan police station.

It was the Sonhan PS which lodged an FIR in the case on September 2 this year after the court of Bhabhua chief judicial magistrate (CJM) forwarded a complaint case to it for investigation. In his complaint, filed in the CJM’s court on August 18, one Shah Mohammad of Khair village alleged that his 18-year-old daughter Akhtari Begum, who was married to one Md Tajuddin of Pawandi village in Rohtas district, was killed by her husband and in-laws on July 26 for dowry. As it happens in such cases, all the in-laws were named as accused.

On September 24, Bhabhua DSP Kumar along with the investigating officer visited Pawandi and supervised the case. He also interrogated the minor sisters and arrested the girl’s father-in-law. His supervision note concluded that the accusation appeared to be true as those named accused had tortured and assaulted Akhtari to death for dowry. Akhtari was the wife of the brother of Chaniya and Soni, who study in a primary school.

Srivastava just okayed the DSP’s findings and ordered the arrest of the accused. In case they elude police, their property will be attached, he further ordered.

Ironically, Srivastava on Monday evening told TOI: “Aisi galtiya hote rahti hai (Such mistakes keep happening)” if the children are named accused and witnesses also corroborate the accusation. When told about IPC and asked about police wisdom, he said: “We will do something about it now.”

A senior lawyer and member of the Bihar Bar Council described the police action as illegal. “Nor only does it border on incredulity, but it also reveals an insensitive face of the state police,” said Akhauri Mangala Charan Srivastav.

No this is not a one-off case of its kind. Earlier this month, this newspaper reported how an SP found the accusation true against all the members of a family in a case of kidnapping that never took place. So, all of them, including an octogenarian, were jailed for months.

In another case, an alleged murderer fooled police into arresting two innocent persons for the crime he had committed.

Taking cognizance of the two cases of “violation of rights of innocent persons by police” the State Human Rights Commission has sought a reply from director-general of police Anand Shankar.

By the way, this still does not beat the previous record of police for arresting a 57 DAYS old baby for dowry torture. See the video at

Employers cannot be forced to take back convicts: HC

Various law enforcement (a.k.a police) and criminal trial authorities (a.k.a. courts) need some serious training as to what different sections of I.P.C. mean.

In the below case, the whole trial happened under both IPC 302 and 306.

302 is punishment for murder. 306 is abetment to suicide. Isn’t it common sense that the death was either a murder or a suicide? How can it be both?

(For my blog readers who have advanced knowledge of law: Even if it was suicide that is assumed to be dowry death, then also section 304 (b) should apply and not 302.)

My country is great. A person was in custody for 5 years and absolutely no one (police, court, lawyer) objected to the mis-founded justice.

Mumbai: Employers cannot be forced to retain an employee convicted for a serious offence, ruled the Bombay high court.

In a judgment last week, justice Dr DY Chandrachud set aside two judgments of a labour and industrial court, which early this year had directed Tata Power Limited to reinstate an employee and also pay him back wages since 1998.
The court also ruled that holding of departmental inquiry is not compulsory if the employee stands convicted for a criminal offence.
“Once there is a conviction by a court of law and conviction is of criminal offence involving moral turpitude, the charge of misconduct stands established. In a case, where a workman had been convicted by a court of competent jurisdiction, the holding of departmental inquiry would be entirely superfluous,” observed justice Chandrachud.
The court was hearing an appeal filed by Tata Power Ltd. The power giants had moved high court, challenging the orders of labour as well as industrial courts, which had directed them to reinstate one KT Mane and also to pay him back wages since 1998.
Mane, according to the 14-page judgment, was convicted under section 498A and 306 by a session court in December, 1997. Mane was also arrested under section 302 after his wife died due to burn injuries in December 1993. The session court, however, acquitted him of murder charges, but convicted him for five years imprisonment for the other two charges. He was released from prison in February 1998, as he was in custody since his arrest in December 1993.
The company had then refused him to reinstate on the same post and had also issued him a show-cause notice. Mane then moved labour court that ruled in his favour. Even the industrial court had judged in favour of Mane.
The judgment further says: “Both the labour court and the industrial court failed to appreciate the correct legal position and manifestly erred in holding that the action of the employer of dismissing the workman had to be set aside for want of a departmental inquiry.”
Observing that the workman failed to discharge his moral duties, justice Chandrachud also set aside the lower court’s order of paying back wages to the workman.
The court has also granted liberty to Tata Power to withdraw Rs1.71 lakh deposited with the labour court.

अभी तक ज्यादातर महिलाओं पर अत्याचार के मामले सामने आते रहे हैं। इसे रोकने के लिए सशक्त कानून भी बनाए गए हैं। समय बदल रहा है। महिला सशक्तिकरण के जमाने में अब पति पत्नी से पीडि़त हैं। चाहे वे पत्नी के लगाए गए दहेज प्रताडऩा और घरेलू हिंसा के झूठे आरोप हों या फिर घर में आपसी कलह। पत्नी पीिड़ता कहां जाए? न कोई हमदर्दी न कोई सरकारी मदद। नतीजा? पीड़ित पतियों के आत्महत्या का अनुपात पीड़ित पत्नियों से दोगुना है.

इस तथ्य पर बाद में आते हैं लेकिन पहले आपको यह बताते हैं कि 19 नंवबर को तंग पति अंतरराष्ट्रीय पति दिवस के रूप में मनाते हैं। पार्टी करके। बैठक करके। फिल्म देखकर। कुछ पीड़ितों का समूहिक पिकनिक मनाकर एक दिन खुशियों को जी रहे हैं। अपने लिए शायद वैसा दिन पत्नी के साथ फिर कभी नहीं जी पाएंगे। हकीकत बदल रही है। यकीन मानिये जितनी हिंसा महिलाओं के साथ हो रही है, वैसी ही हिंसा पुरुषों के साथ हो रही है। दो वर्ग बन गए हैं। एक ओर जहां पति पत्नी को पीटता है, वहीं दूसरे वर्ग में पत्नी से पति पीडित होकर दिल में टीस लिए जिंदगी से हर आस छोड़ रहा है।

पहली बार त्रिनिदाद और टोबैगो में 1999 में 19 नवंबर को अंतरराष्ट्रीय पुरुष दिवस के रूप में मनाया गया। भारत में इसी शुरुआत 2007 से हुई। पत्नी से प्रताडि़त होने के मामले में देश का कोई शहर अछूता नहीं है। बस अंतर इतना है कि महिलाओं से जुड़ी हिंसा को मीडिया ज्यादा कवरेज देता है। पीड़ित पति शर्म संकोच से कहीं नही जाते हैं। करीब डेढ़ दशक पूर्व दिल्ली के विभिन्न इलाकों में कई जगह लिखा हुआ मिलता था – पत्नी सताएं तो हमे बताएं, मिले नहीं लिखें। अब वो तख्ती तो नहीं दिखती है, लेकिन पीड़ित बढ़ गए हैं.

आए दिन शादीशुदा पुरुषों की आत्महत्या के मामले प्रकाश में आते हैं। पर इसके पीछे की सच्चाई से बहुत कम ही लोग ही रू-ब-रू हो पाते हैं। कई बार इन कानूनों का दुरुपयोग कर पत्नी पति को प्रताड़ित करती है। इससे तंग आकर अनेक लोगों ने आत्महत्या की राह चुनी है।

वर्षों गुजर गए। पत्नी पीड़ितों के समूह ने संगठित होकर सरकार से लगातार संघर्ष कर देहज उत्पीडन के कानून 498-ए में बदलाव कर इस जमानती बनाने की मांग कर रहा है। बदलाव के लिए सरकार विचार कर रही है। संगठन अलग पुरुष कल्याण मंत्रालय की मांग कर रहे हैं। पुरुषों के पक्ष में दस्ताबेज जुगाड़ कर सरकार के पास ज्ञापन भेजकर लगातार दवाब बना रहे हैं। कई शहरों में पत्नी पीडि़तों का समूह कही चुपचाप तो कहीं खुलेआम बैठक करते हैं। एक-दूसरे की समस्या सुनते हैं और सहयोग करते हैं। जब नया पीड़ित आता है तो उनकी काउंसलिंग होती है जिससे कि वह आत्महत्या न कर सके।

पत्नी पीड़ित राजेश बखारिया दहेज उत्पीडऩ कानून के चक्कर में वर्षों से कोर्ट के चक्कर काटते-काटते इस अपने जैसे दूसरे पीड़ितों का दु:ख दर्द बांटते हैं। सहयोग करते हैं। कहते हैं कि अब तो नई नवेली दुलहन भी छोटी-छोटी बात पर दहेज विरोधी काननू का हवाला देकर घर-परिवार में वर्चस्व जमाने की कोशिश करती हैं। खेद की बात है कि जैसे ही पत्नी आरोप लगाती है और बात थाने तक पहुंचती है और मामला दर्ज होता है तो पति को जेल जाना पड़ता है। वह घोर अवसाद का शिकार हो जाता है। पत्नी की हरकतों से बेटे-भाई की जिंदगी में पडऩे वाली खलल से कई मां-बहनों का दिल टूटा है। युवा पति कोर्ट-कचहरी के चक्कर काटते-काटते अधेड़ हो रहे हैं। लिहाजा, इस चक्कर में पड़े अधिकतर लोग आत्महत्या को अंतिम विकल्प मान लेते हैं। क्योंकि जैसे ही पत्नी के अरोप पुलिस दर्ज करती है, नौकरी चाहे सरकारी हो या निजी चली जाती है।

श्रम और रोजगार मंत्रालय के वर्ष 2001-05 के जारी आंकड़ों के मुताबिक निजी और सार्वजनिक क्षेत्रों से करीब 14 लाख लोगों को अपनी नौकरी से हाथ धोना पड़ा। कई सर्वे व जांच में यह बात सामने आ चुकी है कि आईपीसी की धारा 498 ए का बड़े पैमाने पर दुरुपयोग हो रहा है। इसके तहत कई पतियों पर दहेज के लिए पत्नी को प्रताड़ित करने के झूठे अरोप लगे हैं। दो साल पूर्व लागू घरेलू हिंसा उन्नमूलन कानून 2005 से तो महिलाओं को और ताकत दे दी है। उच्चतम न्यायालय ने वर्ष 2006 में एक सिविल याचिका 583 में यह टिप्पणी की थी कि इस कानून को तैयार करते समय कई खामियां रह गई हैं। उन खामियों का फायदा उठा कर कई पत्नियां पति को धमका रही हैं। उन्होंने बताया कि आंकड़े देखें तो औसतन जहां हर 19 मिनट में देश में किसी व्यक्ति की हत्या होती है, वहीं हर 10 मिनट में एक विवाहित व्यक्ति आत्महत्या करता है। वर्ष 2005-07 के आंकड़ों के मुताबिक दहेज उत्पीडऩ मामले में कानून की धारा 498-ए, के तहत 1,39,058 मामले दर्ज हुए।

पत्नी पीड़ितों की एक संस्था सेव इंडिया फैमिली फउंडेशन पत्नी पीड़ितों को काउंसलिंग से मामले सुलझाने की कोशिश करता है। फाउंडेशन सरकार पर लगातार स्वतंत्र रूप से पुरुष कल्याण मंत्रालय बनाने की मांग कर रहा है। श्री बखारिया का कहना है कि यदि पत्नी किसी भी कारण से आत्महत्या करती है तो पुलिस तुरंत केस दर्ज कर आरोपियों को हवालात में ले लेती है। घर घरेलू कलह से तंग आकर पति आत्महत्या करता है तो पत्नी से पूछताछ तक नहीं होती है। पत्नी के प्रताड़ित करने के अधिकतर मामले साल 2000 से तेजी से बढ़े हैं। इसका प्रमुख जिम्मेदार टीवी पर प्रसारित होने वाले कुछ धारावाहिक हैं जिनकी अनाप-शनाप कहानी में नकारात्मक छवि वाली महिला पात्रों ने समाज में गलत असर छोड़ा है। लड़कों वालों में वधु पक्ष के परिवार के अनावश्यक हस्तक्षेप बढ़ा है जिससे महिलाओं में अहम आ जाता है।

Police officer set on fire by wife

ASI set on fire by wife on Int’l Men’s Day

Wife burns the husband and husband sustains 85% burns, and the police is investigating the matter. We all know what happens when the wife just says ‘my husband has hit me’!
A quarrel over a petty issue took an ugly turn when an enraged wife set her husband, a police officer, on fire here, police said on Thursday.
The victim, 52-year-old assistant sub-inspector Balwant Pawar, sustained 85 per cent burns and is admitted to Government Medical College and Hospital, Aurangabad. Ironically, the incident took place on International Men’s Day.
According to police, Pawar had a tiff with his wife over some petty issue on Wednesday night when he returned home. Irked over this, she poured kerosene over him and set him on fire, they said.
Pawar was working with the MIDC Cidco police station. The Begampura police have registered a case and are investigating further.

Police inspector commits suicide bec of wife torture

NOTICE THE BIAS: It is known that the suicide happened because of the torture from wife, and the police is still probing the matter further. If it was a wife who died for any reason, her husband would have been arrested automatically!
AMRAVATI: A police sub inspector, presently posted at Akola Control Room, shot himself with his service revolver in the wee hours of Thursday at Amravati.
According to information from the police department, the deceased PSI has been identified as Amol Datir (42), a resident of Jagriti Colony in Amravati. He had been posted to Akola Control Room some time back. PSI Datir was an intelligent officer, his fellow officers have said. He had completed his MSc and then passed the MPSC exam in the first attempt in 1995.
On Wednesday night, at around 1.50am, Datir shot himself with his service revolver and died on the spot. Sources said that he had a dispute with his wife, who had lodged a complaint against him in 2006 at Akola police station. After this complaint, offences had been registered against PSI Datir under 498 section of IPC. It is also learnt that his wife had filed a case against him and demanded alimony from him. The hearing in this case was scheduled on Thursday.
Datir had been under tremendous tension after his wife lodged the complaint against him, as she had also levelled allegations against Datir’s family members also. Sources also said that Datir had been suffering from peptic ulcer since many days and had been on leave for the last three months. It is conjectured that Datir took the extreme step due to tremendous pressure on him.
Gadge Nagar police have registered offences under relevant sections of IPC and are probing the matter further.
