Marriage versus prostitution

This idea came to my mind, because a reader of my blog commented that “Men marry attractive body and women marry bank balances”. (It is comment number 5 at http://wp.me/plC3a-a9)

I went and searched for the definition of prostitution: The act or practice of engaging in promiscuous sexual relations especially for money.

I searched for prostitution first, not because prostitutes interest me more than wives (if there is any difference between the two), but because I knew finding the definition of prostitution is going to be relatively easy task.

A general definition of marriage is that it is a legal and social contract between two individuals that gives legitimacy to sexual relations.

So, both serve one main purpose, the purpose of physical pleasure. Now, let us evaluate the 2 ‘professions’ on the following 3 parameters – variety, switching costs, and quality.

Adultery is a crime for men under IPC 497, while women can do it legally. IPC 497 applies only to men.

As desired

You can go to different service providers as per your desires. You are not bound by any ‘contract’ called marriage.

Switching Costs

(Switching from one woman to the other)

Very high

In order to switch wives, you would need to divorce the first one, and divorce is an expensive affair.

Minimal

There is no cost involved in switching commercial sex workers

Customer Service Quality Low

The service provider doesn’t care whether the consumer is satisfied or not, he will still have to pay for her whether he continues to use the service or not.

High

Repeat business is a customer’s choice.

Hence, marriage is equivalent to prostitution in the following manner:

  1. You might get sex in marriage

I am using the word ‘might’ because you can not have sex against your               spouse’s wishes. So if you are lucky, then you will get sex.

2. You are obliged to maintain the woman financially

But marriage is different from prostitution in the following:

  1. You have to pay for her irrespective of whether you get anything from her in return or not.

2. If you sleep with someone else, that is illegal.

To summarize:

Men do not even get from their wives what they get from prostitutes. Even if the wives were as good, then also marriage can at best be described as long-term prostitution unless the women of this nation start to take equal responsibilities of running the household.

Allow Daughters to take responsibility legally

Seeing the news article, Moms held for bid to swap babies, I noticed one interesting thing, “One of the women, who has two daughters, wanted a male child while the other, who has a son, wanted a girl”.

One might argue that it is such attitude that leads to “Female Feticide”, however, “Reality is seldom the same as perception”, like the perception that women are the oppressed lot and the reality that men commit more suicides.

Similarly, in the area of female feticide, it is a perception that it happens because a daughter is a burden and people tend to have sons, however, that is not the reality.

If we note carefully Section 125 of the Code of Criminal Procedure (CrPC) allows parents to seek maintenance from sons only and not from daughters. Thus, no parent can legally enforce a daughter to take care of them in old age, even if the daughter wants to and the couple has no son.

It is but obvious that anyone would vouch for a son, after all, who would want a child who cannot be enforced legally to take responsibility when expected. It is not that people have some extra love for sons; it is just that the society wants a DISPOSABLE MALE to discharge all the duties and responsibilities.

If daughters are allowed to take responsibility legally, not only will the problem of female feticide be addressed effectively, men will also get “Freedom of Choices”, currently lacking in their gender role in the society.

Women’s activist, instead of suggesting effective solutions for addressing the problem of the skewed gender ratio, indulged in rhetoric and large-scale male bashing. They used the issue of skewed gender ratio as a journey to achieve the destination of biased, gender obsessed, and unconstitutional anti-male laws to castrate men and in turn led to a society where all laws are protecting women while men are committing suicides in skyrocketing numbers burdened in a society that does not accept them and only expects from them and at the same time no improvement in the skewed gender ratio as well.

It clearly tells us that women’s activists have miserable failed in their projected objective and the only way to solve the crisis is to allow women to take responsibility legally.

Having access implies responsibility of her by-products

Look at how deadly the laws in my country are:

Did you guys know – Any child born to your wife is your legitimate child irrespective of whether we were ever physically intimate or not?

There is no DNA test required, nothing.

The law says – Just because you have access to her, you are responsible for everything that she breeds.

This is what the section 112 of the Indian Evidence Act says – Any child born to my wife is my legitimate child irrespective of whether we were ever physically intimate or not.

112. Birth during marriage, conclusive proof of legitimacy

The fact that any person was born during the continuance of a valid marriage between his mother and man, or within two hundred and eighty days after its dissolution, the mother remaining unmarried, shall be conclusive proof that he is the legitimate son of that man, unless it can be shown that the parties to the parties to the marriage had no access to each other at any time when he could have been begotten.

Being a lawyer myself, I can tell you that not having access to a wife can be proved only when the situation is really drastic – e.g. you both are living in different countries.

So guys – beware. Any child born to your wife is yours (irrespective of who is the biological father). India is great!

States told to prevent harassment of husbands

New Delhi, Dec 3 (IANS) The government has received several representations regarding misuse of an Indian Penal Code (IPC) provision that deals with dowry harassment and an advisory has been issued to state governments to prevent its misuse, the Lok Sabha was informed Thursday.
In a written reply, Minister of Law and Justice M. Veerappa Moily said: “A number of representations have been received from various quarters regarding the misuse of the provision of Section 498A of IPC. Information regarding its misuse is not collected by the National Crime Records Bureau.”
Section 498A of the IPC deals with cases of dowry harassment.
“The matter has been referred to the Law Commission of India to study the use of the provision of this section and hold consultations and suggest amendments, if any, to the provision.
“An advisory has also been issued to the state governments to prevent the misuse of the said section,” he added.

Orissa villagers file case for female monkey!

India has taken male torture to an altogether new height by extending the gender bias against males to animal species also:

Bhubaneshwar (Orissa), Nov 17 (ANI): In a bizarre development, residents of a village near Bhubaneshwar, Orissa, have filed a case against a male monkey for attempting to attack and kill a female monkey and its newborn.

The case was filed at a police station near the village.

Villagers said in their complaint that the male monkey- Raja had been consistently trying to attack the female monkey- Jhumri and its dear newborn at Astaranga.

Police have registered a case under three sections of the Indian Penal Code, which includes section 363 (kidnapping), 366 (abducting for slavery) and 507 (criminal intimidation by anonymous communication) and 511 (punishment for attempting to commit offences).

“If a female will place a complaint before me about her son going to be kidnapped or murdered by anyone, then a cognizable offence under section 366, 363, 507 and 511 of the Indian Penal Code will be registered. The accused and his associates would also be arrested and necessary police protection would be given,” said Jatindra Kumar Das, a police official.

According to the complaint filed before the Police, Raja had already killed its first child and was now hunting down its second baby as well. (ANI)

Purushottam Mahajan was physically and mentally abused by his wife, he has videotapes of about 60 days of abuse, many men do not even have this evidence, some of them suicide!. The Police has not yet taken action on Purushottam’s complaint against spousal-abuse, even after 2 years of his complaint to various police and other authorities.

Indian Men are leading a troubled and stressed-out life and as per National Crime Records Bureau, almost 75000 men committed suicide in 2006. This is almost 80% more than women who have committed suicide (app. 42000).

WHAT THIS MEANS? Under the age of 14, women are 6% more likely to commit suicide, but the suicide rate increases drastically upto 116% more for males WHEN CHILDREN START TO TAKE GENDER BASED ROLES!

पत्नियों से ज्यादा पीड़ित पति

अभी तक ज्यादातर महिलाओं पर अत्याचार के मामले सामने आते रहे हैं। इसे रोकने के लिए सशक्त कानून भी बनाए गए हैं। समय बदल रहा है। महिला सशक्तिकरण के जमाने में अब पति पत्नी से पीडि़त हैं। चाहे वे पत्नी के लगाए गए दहेज प्रताडऩा और घरेलू हिंसा के झूठे आरोप हों या फिर घर में आपसी कलह। पत्नी पीिड़ता कहां जाए? न कोई हमदर्दी न कोई सरकारी मदद। नतीजा? पीड़ित पतियों के आत्महत्या का अनुपात पीड़ित पत्नियों से दोगुना है.

इस तथ्य पर बाद में आते हैं लेकिन पहले आपको यह बताते हैं कि 19 नंवबर को तंग पति अंतरराष्ट्रीय पति दिवस के रूप में मनाते हैं। पार्टी करके। बैठक करके। फिल्म देखकर। कुछ पीड़ितों का समूहिक पिकनिक मनाकर एक दिन खुशियों को जी रहे हैं। अपने लिए शायद वैसा दिन पत्नी के साथ फिर कभी नहीं जी पाएंगे। हकीकत बदल रही है। यकीन मानिये जितनी हिंसा महिलाओं के साथ हो रही है, वैसी ही हिंसा पुरुषों के साथ हो रही है। दो वर्ग बन गए हैं। एक ओर जहां पति पत्नी को पीटता है, वहीं दूसरे वर्ग में पत्नी से पति पीडित होकर दिल में टीस लिए जिंदगी से हर आस छोड़ रहा है।

पहली बार त्रिनिदाद और टोबैगो में 1999 में 19 नवंबर को अंतरराष्ट्रीय पुरुष दिवस के रूप में मनाया गया। भारत में इसी शुरुआत 2007 से हुई। पत्नी से प्रताडि़त होने के मामले में देश का कोई शहर अछूता नहीं है। बस अंतर इतना है कि महिलाओं से जुड़ी हिंसा को मीडिया ज्यादा कवरेज देता है। पीड़ित पति शर्म संकोच से कहीं नही जाते हैं। करीब डेढ़ दशक पूर्व दिल्ली के विभिन्न इलाकों में कई जगह लिखा हुआ मिलता था – पत्नी सताएं तो हमे बताएं, मिले नहीं लिखें। अब वो तख्ती तो नहीं दिखती है, लेकिन पीड़ित बढ़ गए हैं.

आए दिन शादीशुदा पुरुषों की आत्महत्या के मामले प्रकाश में आते हैं। पर इसके पीछे की सच्चाई से बहुत कम ही लोग ही रू-ब-रू हो पाते हैं। कई बार इन कानूनों का दुरुपयोग कर पत्नी पति को प्रताड़ित करती है। इससे तंग आकर अनेक लोगों ने आत्महत्या की राह चुनी है।

वर्षों गुजर गए। पत्नी पीड़ितों के समूह ने संगठित होकर सरकार से लगातार संघर्ष कर देहज उत्पीडन के कानून 498-ए में बदलाव कर इस जमानती बनाने की मांग कर रहा है। बदलाव के लिए सरकार विचार कर रही है। संगठन अलग पुरुष कल्याण मंत्रालय की मांग कर रहे हैं। पुरुषों के पक्ष में दस्ताबेज जुगाड़ कर सरकार के पास ज्ञापन भेजकर लगातार दवाब बना रहे हैं। कई शहरों में पत्नी पीडि़तों का समूह कही चुपचाप तो कहीं खुलेआम बैठक करते हैं। एक-दूसरे की समस्या सुनते हैं और सहयोग करते हैं। जब नया पीड़ित आता है तो उनकी काउंसलिंग होती है जिससे कि वह आत्महत्या न कर सके।

पत्नी पीड़ित राजेश बखारिया दहेज उत्पीडऩ कानून के चक्कर में वर्षों से कोर्ट के चक्कर काटते-काटते इस अपने जैसे दूसरे पीड़ितों का दु:ख दर्द बांटते हैं। सहयोग करते हैं। कहते हैं कि अब तो नई नवेली दुलहन भी छोटी-छोटी बात पर दहेज विरोधी काननू का हवाला देकर घर-परिवार में वर्चस्व जमाने की कोशिश करती हैं। खेद की बात है कि जैसे ही पत्नी आरोप लगाती है और बात थाने तक पहुंचती है और मामला दर्ज होता है तो पति को जेल जाना पड़ता है। वह घोर अवसाद का शिकार हो जाता है। पत्नी की हरकतों से बेटे-भाई की जिंदगी में पडऩे वाली खलल से कई मां-बहनों का दिल टूटा है। युवा पति कोर्ट-कचहरी के चक्कर काटते-काटते अधेड़ हो रहे हैं। लिहाजा, इस चक्कर में पड़े अधिकतर लोग आत्महत्या को अंतिम विकल्प मान लेते हैं। क्योंकि जैसे ही पत्नी के अरोप पुलिस दर्ज करती है, नौकरी चाहे सरकारी हो या निजी चली जाती है।

श्रम और रोजगार मंत्रालय के वर्ष 2001-05 के जारी आंकड़ों के मुताबिक निजी और सार्वजनिक क्षेत्रों से करीब 14 लाख लोगों को अपनी नौकरी से हाथ धोना पड़ा। कई सर्वे व जांच में यह बात सामने आ चुकी है कि आईपीसी की धारा 498 ए का बड़े पैमाने पर दुरुपयोग हो रहा है। इसके तहत कई पतियों पर दहेज के लिए पत्नी को प्रताड़ित करने के झूठे अरोप लगे हैं। दो साल पूर्व लागू घरेलू हिंसा उन्नमूलन कानून 2005 से तो महिलाओं को और ताकत दे दी है। उच्चतम न्यायालय ने वर्ष 2006 में एक सिविल याचिका 583 में यह टिप्पणी की थी कि इस कानून को तैयार करते समय कई खामियां रह गई हैं। उन खामियों का फायदा उठा कर कई पत्नियां पति को धमका रही हैं। उन्होंने बताया कि आंकड़े देखें तो औसतन जहां हर 19 मिनट में देश में किसी व्यक्ति की हत्या होती है, वहीं हर 10 मिनट में एक विवाहित व्यक्ति आत्महत्या करता है। वर्ष 2005-07 के आंकड़ों के मुताबिक दहेज उत्पीडऩ मामले में कानून की धारा 498-ए, के तहत 1,39,058 मामले दर्ज हुए।

पत्नी पीड़ितों की एक संस्था सेव इंडिया फैमिली फउंडेशन पत्नी पीड़ितों को काउंसलिंग से मामले सुलझाने की कोशिश करता है। फाउंडेशन सरकार पर लगातार स्वतंत्र रूप से पुरुष कल्याण मंत्रालय बनाने की मांग कर रहा है। श्री बखारिया का कहना है कि यदि पत्नी किसी भी कारण से आत्महत्या करती है तो पुलिस तुरंत केस दर्ज कर आरोपियों को हवालात में ले लेती है। घर घरेलू कलह से तंग आकर पति आत्महत्या करता है तो पत्नी से पूछताछ तक नहीं होती है। पत्नी के प्रताड़ित करने के अधिकतर मामले साल 2000 से तेजी से बढ़े हैं। इसका प्रमुख जिम्मेदार टीवी पर प्रसारित होने वाले कुछ धारावाहिक हैं जिनकी अनाप-शनाप कहानी में नकारात्मक छवि वाली महिला पात्रों ने समाज में गलत असर छोड़ा है। लड़कों वालों में वधु पक्ष के परिवार के अनावश्यक हस्तक्षेप बढ़ा है जिससे महिलाओं में अहम आ जाता है।

Women not required to produce evidence

In keeping up with the sexist attitude of the country, the Delhi court has ruled that – Asking a girl for evidence is insulting her.

The basic principal on which the whole Indian society is based – Women never lie.

NEW DELHI: A Delhi court has said the testimony of a rape victim is “sufficient” enough to convict the accused and asking her to corroborate her

version by producing more witnesses will be insulting.
“The statement of the prosecutrix alone is sufficient and needs no corroboration. The conviction can be founded alone unless there are compelling reasons.
“In my opinion, it would be adding insult to tell a female that her story of woes would not be believed unless it is corroborated in material particulars in the case,” District and Sessions Judge P S Teji, quoting various judgements of the Supreme Court, said.
The court’s observation came while awarding rigorous life imprisonment to convict Raju, a resident of east Delhi for raping his five-year-old neighbour.
It trashed the plea of convict that he was implicated by the girl and her family members as no independent witness was examined against him by the prosecution.
“In the traditional non-permissive bounds of India, no girl or woman would falsely implicate somebody for ravishing her chastity by sacrificing and jeopardising her future prospects,” it said, lending credence to testimonies of the victim and her parents.
It also imposed a fine of Rs 10,000 on convict, who raped the minor on the night of May 31, 2006 after taking her to a secluded place.
